ADC Chairman, Dr Dvir Abramovich, issued the following statement regarding S18C of the RDA in light of the QUT case and vigorous public debate concerning its retention:
“While the ADC welcomes the intense public discussion taking place regarding section 18C of the Racial Discrimination Act (RDA), we have repeatedly argued for its retention, contending that strong racial vilification laws are an essential, effective and necessary tool in addressing and combatting the unique harm caused by racial and bias-motivated hate speech. If applied correctly and in appropriate cases, 18C does not curb free speech, and as the QUT case amply demonstrated, the courts will reject expressions or words that do not cause “offence, insult, humiliation or intimidation which has profound and serious effects”. As the robust political debate around this critical issue endures, we will continue to argue that 18C, which is vital to safeguarding individuals and communities in the rich fabric of our multicultural nation and which goes beyond party politics, should not be diminished or diluted and that any such actions would send the wrong message.”
